Terms of Service

These Terms of Service (“Terms”) govern your use of Harbor (the “Service”), operated by Harbor (“we,” “us,” “our”). By accessing or using Harbor you agree to be bound by these Terms. If you don't agree, don't use the Service.

Who can use Harbor

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. Harbor is built for independent commission artists — solo operators selling their own creative work. Use by agencies or teams is not currently supported.

Your account

You're responsible for keeping your account credentials secure. Notify us immediately if you suspect unauthorized access. You're responsible for everything that happens under your account.

Your content and your business

You retain ownership of all content you upload, create, or otherwise contribute to Harbor — including your business knowledge base, bot message templates, portfolio uploads, and any work product associated with commissions. You grant us a limited license to host, display, and process this content solely for the purpose of providing the Service.

Harbor is a tool. The work you sell, the prices you charge, the agreements you make with buyers, and the quality of your delivery are entirely your business. Harbor is not a party to any commission agreement between you and your buyers.

Buyer interactions

When you use Harbor to communicate with your buyers (via the Discord bot, Instagram integration, email, or otherwise), you remain responsible for the substance of those communications, including any commitments made. You agree to comply with each platform's terms (Meta's Platform Terms, Discord's TOS, etc.) when using them through Harbor.

Payments

Harbor charges a subscription fee (and, on certain tiers, a small percentage of transactions) for use of the Service. Pricing is shown in your billing settings before you subscribe. Subscriptions auto-renew unless cancelled. You can cancel any time from billing settings; the cancellation takes effect at the end of the current billing period.

Buyer payments to you are processed by Stripe under their terms. Funds from commission payments go directly to your connected Stripe account. Harbor takes its platform fee through Stripe's application fee mechanism on each transaction.

Refunds

Subscription fees are non-refundable except as required by law. If you believe you were charged in error, contact us within 30 days at billing@harborstudio.ai.

Refunds between you and your buyers are governed by the agreement you have with them. Harbor does not arbitrate refund disputes.

Acceptable use

  • No spam or unsolicited commercial messaging via Harbor's bot or email systems.
  • No attempts to circumvent platform rate limits, security measures, or anti-abuse protections.
  • No reverse engineering, scraping, or automated bulk extraction of Harbor's data.
  • No use of Harbor for illegal activity or to facilitate harm to others.
  • No content that exploits or endangers minors.
  • No content that infringes third-party intellectual property.

Termination

We can suspend or terminate accounts that violate these Terms. You can close your account at any time. Upon closure your data is retained for 30 days then permanently deleted, per our Privacy Policy.

Service availability

We work to keep Harbor available and functioning, but we don't guarantee uninterrupted service. Scheduled maintenance, third-party outages (e.g. Stripe, Discord), and unforeseen issues happen. We'll communicate significant outages and don't make uptime SLA commitments at this stage.

AI features

Harbor includes AI-assisted features (the Sean advisor, conversational bot responses, intent classification). These are provided as productivity tools. Their suggestions, generated text, and decisions are not a substitute for your judgment. You're responsible for reviewing and approving anything the AI produces before it goes to a buyer or affects your business.

Disclaimers

Harbor is provided “as is” without warranties of any kind, express or implied. We don't warrant that the Service will meet your requirements, be error-free, or operate uninterrupted.

Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to these Terms or the Service is limited to the greater of $100 or the amount you paid us in the twelve months preceding the claim. We're not liable for indirect, incidental, special, consequential, or punitive damages.

Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email at least 30 days before they take effect. Continued use of Harbor after the change indicates acceptance.

Governing law

These Terms are governed by the laws of the United States and the State of New York, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in New York County, New York.
